Walmart Cannot Toss Out Claims for Faulty Coffee Filters

On June 5, 2018, United States District Court Judge Cynthia A. Bashant found that Plaintiff Gina Beckman's ("Plaintiff") putative class action adequately asserted claims for breach of warranty and violations of California's Unfair Competition law against Defendants Wal-Mart Stores, Inc., Espresso Supply, Inc., EKO Brands, LLC and EKOBREW ("Defendants"). Plaintiff's lawsuit alleges that Brew & Save branded reusable carafe filters are advertised by Defendants as being compatible with Keurig® 2.0 and 1.0 models. However, the carafe filters are not compatible with Keurig® 2.0 and 1.0 models. Read Plaintiff's complaint.
